Witnesses to a shooting at Mendez Middle School on Thursday told police that the men involved in the fight that lead to Vidal Lopez's death were members of rival gangs, according to an arrest affidavit.

Lopez, 21, was fatally shot in the face after he got into an argument with Rodolfo Orive, 20, and Froylin Hernandez, 17, the affidavit says. Orive has been charged with murder and is being held at the Travis County Jail with bail set at $150,000. Hernandez has been charged with aggravated assault and is being held at Travis County Jail with bail set at $100,000.

Hernandez said that he and Orive were members of a gang and that Lopez was affiliated with a rival gang, police said.

Witnesses told police that Lopez had Orive in a headlock and was winning the fight before Hernandez pointed a .357-caliber revolver at Lopez and told him to release Orive, according to the affidavit.

When Lopez let Orive go, Orive ordered Hernandez to shoot Lopez, the affidavit says. Hernandez hesitated, witnesses told police, and Orive grabbed the gun and shot Lopez in the face.

Lopez's brothers deny that he was a gang member.


Police find seriously injured men


Two men were hospitalized Sunday night after police found them injured in an apartment in the 2300 block of Corta Street in East Austin about 10:30 p.m., police say.

One man had a gunshot wound, police spokeswoman Laura Albrecht said, and the other man had a stab wound. Their names were not released.

They were taken to Brackenridge Hospital with potentially life-threatening injuries. Albrecht said detectives are investigating.
